Use of this site requires that you accept the use of cookies, which are small data files that this site sends to your browser for storage on your computer’s hard drive. Unless otherwise specified herein, PatientEvolution reserves the right to compile, save, use within the scope of our activities, and analyze any and all data about you (contact and personal information, use history, etc.) that we collect from you through this site. In general, personal information you submit to us is used either to respond to requests that you make, or to aid us in serving you better. We may use your personal information for screening, contact and follow-up. We may also use your personal information to communicate regarding newsletters, press releases, or information relating to studies that may be of interest to you.

If you provide information to any other third party (including through any primary or secondary phone screenings) in connection with your use of this site or associated screening, we may receive and use that information as set forth herein.

We may also maintain archived copies of any information that we collect for purposes of measurement and back-up.

  1. Anonymous Information

We may create anonymous data records from information by excluding information (such as your name) that otherwise renders the data not personally identifiable to you. We reserve the right to use this anonymous data within the scope of our activities, including analyzing request and usage patterns so that we may enhance the content of our services and improving site navigation. For example, we may track the number of visitors who view certain pages or use certain features of the site in a particular geographic region. We reserve the right to use and disclose anonymous data to third-party companies for any purpose in our discretion.

In connection with your use of the site, we may share your information with trusted third-party partners in order to provide you the services described herein, for example we may provide your information to a third-party partner that may conduct a secondary phone screening or a potential clinical site. Both we and third-party partners shall only use your information for the purposes of screening, contact and follow-up. You expressly consent to the sharing of your information with our contractors and other service providers for the sole purpose of providing services to you.

We may disclose information to fulfill certain legal and regulatory requirements, or if we believe, in good faith, that such disclosure is legally required or necessary to protect others’ rights or to prevent harm.

We may share some or all of your information with Affiliates (as defined herein), in which case we will require our Affiliates to honor this Privacy Policy. “Affiliates” are defined to include any subsidiaries, joint ventures, or other companies under our common control or, if applicable, the common control of a parent entity. The rights and obligations of PatientEvolution, regarding your information collected by PatientEvolution as described herein, shall pass to any successors or assignees of PatientEvolution.

At any time after you have visited this site, you may contact us at inquiry@patientevolution.com to request access to personal information we have collected regarding you. At any time you can request that we modify or delete your personal information by sending an email to us at inquiry@patientevolution.com with the words “UPDATE MY INFORMATION” in the subject link. We will contact you by email to confirm those changes. Once confirmed, any new item of information will replace the corresponding information previously provided.

  1. Security

We may or may not use encryption methods to transmit your personal information from your computer to ours. Please remember that you play a valuable part in security as well. After you have finished using our site, you should exit your browser so no unauthorized persons can use this site. Regardless of the precautions taken by you or by us, “perfect security” does not exist on the Internet. We cannot ensure or warrant the security of any information you transmit to us, and you transmit such information at your own risk.

A California resident who has provided personal information to a business with whom he/she has established a business relationship for personal, family, or household purposes (a “California Customer”) may request information about whether the business has disclosed personal information to any third parties for the third parties’ direct marketing purposes. In general, if the business has made such a disclosure of personal information, upon receipt of a request by a California Customer, the business is required to provide a list of all third parties to whom personal data was disclosed in the preceding calendar year, as well as a list of the categories of personal data that were disclosed. California Customers may request further information about our compliance with this law by e-mailing inquiry@patientevolution.com. Please note that we are required to respond to one request per California Customer each year, and we are not required to respond to requests made by means other than through this e-mail address.

This policy shall be governed by the laws of the State of California without giving effect to any conflict of laws principles that may require the application of the law of another jurisdiction. If you feel that your complaint has been addressed incompletely, we invite you to let us know for further investigation. If we are unable to reach a resolution to the dispute we will settle the dispute exclusively under the rules of the American Arbitration Association (www.adr.org) at its Los Angeles, California office. Any election to arbitrate by one party will be final and binding on the other. YOU UNDERSTAND THAT IF EITHER PARTY ELECTS TO ARBITRATE, NEITHER PARTY WILL HAVE THE RIGHT TO SUE IN COURT OR HAVE A JURY TRIAL. YOU ACKNOWLEDGE AND AGREE THAT EACH PARTY IS WAIVING THE RIGHT TO PARTICIPATE AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION OR REPRESENTATIVE PROCEEDING. Further, unless both of us otherwise agree, the arbitrator may not consolidate more than one person’s claims, and may not otherwise preside over any form of any class or representative proceeding.

PatientEvolution and its designees retain sole and exclusive ownership of all rights, title and interests in the site and all associated content and all intellectual property rights relating thereto, including any trademarks or logos on the site.

The site and its content are for informational purposes only and are provided AS-IS AND WITHOUT ANY WARRANTIES OR GUARANTIES. PatientEvolution expressly excludes any representation or warranty, express or implied, with respect to the information available on this site. PatientEvolution makes no representation about any third-party websites that may be accessed via links from this site. The site is not intended to be a substitute for professional medical advice, diagnosis, or treatment. Reliance on any information provided by us or third parties, is solely at your own risk.

  1. Changes to Privacy Policy

It may be necessary from time to time for us to modify this Privacy Policy to reflect changes in the way we collect and use information or changes in privacy-related laws, regulations, and industry standards. Accordingly, we reserve the right to change this Privacy Policy at any time by posting a revised policy on this site. This Privacy Policy was posted on May 1, 2018.
